It is a way for me (a lawyer) to offer low cost, affordable, limited scope legal representation services to people in Oklahoma in filing and completing their simple divorce - no contest or by agreement. It is similar to other online divorce filing services, except you have an actual lawyer to talk to, instead of confusing and complicated forms to fill out. It is not full-service legal representation.
This term refers to a lawyer agreeing with an appropriate client to provide less than full-service representation under existing Rule 1.2 (c) of the Oklahoma Rules of Professional Conduct. The Oklahoma Supreme Court added a rule, Rule 33, to the Rules for District Courts of Oklahoma. The rule provides that lawyers who prepare pleadings or other documents to be presented to or filed with the court must disclose their participation on the document, but may do so without entering appearance in the underlying matter. This allows lawyers to proved less than full-service legal representation, which helps keeps legal fees low and affordable.
We will have an actual consultation by phone to see if your situation is appropriate for the limited scope legal representation process. If so, then I will get the information to complete the forms necessary to file your divorce. I will send you the forms to review. I will provide instructions for how to file the forms. I will advise you and provide documents to complete the divorce. I will answer questions and offer advice. I will not appear in court.
This will be more specifically set out in a written agreement. Generally, I will not enter an appearance as your lawyer for court. You will represent yourself in court. I will only assist with paperwork preparation and general advice. I will not appear in court - you will. I will not conduct discovery. I will not file contempt. I will have no conversations or only very limited conversations with a judge or court personnel. Limited scope representation is just that, limited. I will not do many things that a lawyer will do when hired under full service representation.
Typically situations that are agreed to or are no contest. The shorter the marriage, or the longer the separation. No minor children. No significant property or debt situations. No common law marriages. I will not offer limited scope services if it appears there will be contested issues. If you are fighting over custody and visitation, or fighting over property and debt, then limited scope representation is not appropriate. If I begin the limited scope representation process and the case becomes contested, then you will have to hire a lawyer to represent you in court.
